1. The house is sold "as-is". We will be scheduling showings at contact@legacylouisville.com. 24 hours notice required for non-realtors. Open House is TBD.
2. There is a 10% buyer's premium added to the final bid to determine the final contract price.
3. There is a 20% down payment due within 48 hours after the auction closes. Closing within 30 days of the December 15th 2024 auction end date.
4. Online bidding is provided as a complimentary service. The Auctioneers, Legacy Home and Estate Services, the Seller, and the Internet and Software Providers make no assurances or warranties regarding the continuous or error-free operation of the online bidding process and/or system, and shall not be liable in the event of any disruption or malfunction.
5. All descriptions, documents, and details provided are thought to be accurate, however, their accuracy is not warranted. It is incumbent upon Bidders to conduct their own due diligence and thoroughly examine the property as well as all pertinent descriptions, documents, and information to ensure their total satisfaction before placing any bids.
6. Engaging in online bidding constitutes a contractual agreement. It is expected that bidders will commit to their submitted offers and ensure the availability of adequate funds to meet their bid obligations within the designated period. Winners of the bids will be promptly notified following the conclusion of the auction.
7. We have a popcorn bidding or "anti-sniping" feature. This means that any bid that comes within the last few minutes of the auction, the auction will extend.
8. After the auction concludes, the winning bidder will receive a contract via email or direct delivery. This document is required to be signed by the intended purchaser and must be returned to Tom Waggener of Caperton Realty , either through direct handover or via email, by 7:00 p.m. ET on December 17th 2024. The Auction Purchase Contracts can be examined online prior to bidding. Please note that this agreement is final and is not subject to any conditions regarding appraisal, financing, or inspections.
9. Upon executing the Auction Purchase Contract, the buyer is obligated to provide a non-refundable deposit of 20% of the auction. This initial payment must be secured by no later than 7:00 p.m. ET on Tuesday, December 17th 2024. Acceptable forms of payment for the down payment include cash, an official bank check, a certified check, a personal check in good standing, or a wire transfer, all of which should be made payable to Caperton Realty.
10. The finalization of the property sale, or closing, must occur on or before January 15th, 2025. At closing, the Buyer(s) are responsible for paying the remainder of the purchase price. Both Buyer(s) and Sellers are required to cover their individual closing costs, in accordance with what is typical and customary within Jefferson County, Kentucky. It is important to note that this purchase agreement is absolute and not subject to any contingencies related to appraisal, financing, or inspections. The 20% down payment is non-refundable if the winning bidder doesn't close by this date.

All advertised information, such as square footage, lot dimensions, and provided documents, is believed to be correct but is not guaranteed. Potential buyers are welcome to conduct any inspections they desire before the auction; however, the sale is final and not subject to the results of any inspections post-signing of the Real Estate Purchase Contract.
Penalties: Fraudulent bidding will result in legal consequences, and delinquency in payment will preclude the individual from participating in future auctions with Legacy Home and Estate Services (aka Legacy Louisville).

Broker Participation: Brokers or agents with a client who successfully purchases the real estate may be eligible for a 1% participation fee calculated from the final bid amount. The realtor does not bid on behalf of the client, they provide agency support only.
Auctioneer's Right to Bid: In accordance with Indiana Auction Law, with the seller's consent, the auctioneer, broker, agent, and staff members retain the right to place bids. This right also extends to submitting bids on behalf of those who lack online access.
