Legacy Home and Estate Services - Terms of Service

1. Agreement Between User and Legacy Home and Estate Services

Welcome to www.legacylouisville.com and www.legacyhomerealtors.com (collectively, the "Site"). These websites are operated by Legacy Home and Estate Services ("Legacy," "we," "us," or "our"). By using the Site, you agree to these Terms of Service ("Terms"). Please review them carefully.

2. Services Provided

Legacy facilitates the auction of second-hand personal property, free of encumbrances. All items are sold "as is" and "where is."

3. Privacy

Use of the Site is subject to our Privacy Policy, which outlines data collection, storage, and usage practices.

4. Electronic Communications

By visiting the Site or communicating via email, you consent to receive electronic communications from Legacy, which satisfy legal requirements for written communications.

5. User Accounts

  • You are responsible for safeguarding your account credentials.
  • Legacy is not liable for unauthorized access due to theft or misappropriation.
  • We reserve the right to terminate or restrict access at our discretion.

6. Payment Processing & Security

  • Legacy Home and Estate Services does not store or process credit card information.
  • All transactions are securely handled by third-party payment processors, such as Stripe and PayPal.
  • By using our platform, you agree to abide by the terms and policies of these third-party providers.
  • Legacy is not responsible for any security breaches, unauthorized access, or errors in payment processing by these third parties.

7. Auction Item Descriptions & AI Disclosure

  • AI-Generated Descriptions: Some auction item descriptions may be generated using artificial intelligence. While we strive for accuracy, these descriptions are for reference only and should not be relied upon as definitive statements of condition.
  • Condition & Disputes:
    • All items are sold "as is." Any lack of description does not imply perfect condition.
    • Condition assessments are subjective and not grounds for disputes or returns.

8. Bidding & Payment Policies

  • All bids are binding.
  • A valid credit or debit card is required to bid.
  • Payments are processed via Stripe at the close of pickup.
  • Items over $7,500 may require alternative payment methods.
  • Failure to pay may result in account suspension, legal action, and collection efforts.

9. Sales Tax

  • Applicable state sales tax will be added to all purchases.
  • Tax-exempt buyers must provide proper documentation before the auction closes.

10. Auctioneer & Staff Bidding Policy

In accordance with KRS 330.220 (6)(a), Legacy Home and Estate Services allows auctioneers, apprentice auctioneers, and staff to bid on auction items with seller approval. Bidding is conducted transparently, and staff bidding is treated the same as all other bids. No preferential treatment is given to any bidder, including staff.

11. Item Pickup & Shipping

  • Local pickup is required unless shipping arrangements are made.
  • Pickup scheduling is managed through Calendly—buyers must be available during designated times.

Shipping Disclaimer:

  • We have partnered with Fragile Pack of Louisville for shipping. Buyers must contact Scott at (502) 423-0000 for quotes before bidding.
  • Legacy Home and Estate Services is NOT responsible for lost, delayed, or damaged shipments. Once items are transferred to a third-party carrier, all liability transfers to the buyer and shipping provider.

Missed Pickups & Abandoned Items:

  • A $20 late pickup fee applies if alternative arrangements are available.
  • Items left unclaimed for more than two days after auction close will be considered abandoned, with no refunds.
  • Abandoned items may be resold, donated, or disposed of at Legacy’s discretion.

12. Website Availability & Liability Disclaimer

Website Downtime Disclaimer:

  • We do not guarantee uninterrupted access to the Site.
  • Legacy is not liable for site outages, errors, delays, or software malfunctions.

Limitation of Liability:

  • Legacy is not responsible for any direct, indirect, incidental, or consequential damages arising from the use of the Site.
  • Our auction platform is provided as a courtesy, and we make no guarantees of performance.

13. Intellectual Property & Copyright

  • All content, descriptions, images, and branding on this website are the property of Legacy Home and Estate Services or its licensors.
  • Users may not copy, modify, distribute, or exploit any content without written permission.

14. Fraudulent Activity & Account Suspension

  • Legacy strictly prohibits fraudulent bidding, shill bidding, or any attempt to manipulate auction outcomes.
  • Accounts suspected of fraudulent activity may be suspended or permanently banned.
  • Legal action may be pursued against users engaging in fraud or abuse.

15. Accessibility & ADA Compliance

Legacy Home and Estate Services strives to make its website accessible to all users. However, some features may not be fully optimized for individuals with disabilities. 16. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
  • Users outside Kentucky agree to resolve disputes in Kentucky courts or through arbitration.
  • Certain state laws may provide additional rights to bidders outside Kentucky. If you believe you are entitled to additional legal protections, please consult with legal counsel before bidding.

17. Arbitration & Class Action Waiver

  • All disputes shall be resolved through binding arbitration under the Federal Arbitration Act.
  • No class actions—all claims must be filed individually.
