Legacy Consignment Terms

Our mission at Legacy Home & Estate Services is to provide a safe, efficient and accessible platform for people to buy and sell items in a transparent and fair environment. Definition of terms
Consignor means the person or entity who consigns the goods, and Consignee means the person or entity who agrees to sell the goods on consignment through Legacy’s online platform at www.legacylouisville.com.
Nature of the agreement
The Consignor agrees to allow the Legacy to sell the goods on their behalf for a commission (outlined below) , with the understanding that title to the goods remains with the Consignor until sold.
Duration of agreement
This agreement will commence on the date of signature and will continue until item is sold or terminated by written agreement.
Responsibility for goods
The Consignee assumes responsibility for the care and safekeeping of the goods while they are in their possession. Legacy will bear the risk of loss or damage to the goods until sold. Legacy will capture the condition of item(s) during the intake process.
Return of unsold goods
Legacy will return any unsold goods to the Consignor within 10 days of the termination of this agreement. Legacy will make two attempts to auction the consigned items.
Termination of agreement
Either party may terminate this agreement at any time by giving written notice.
Governing law
This agreement will be governed by and construed in accordance with the laws of Kentucky and Indiana state auction guidelines.
Amendment of agreement
This agreement may not be amended except in writing signed by both parties.
Limitation of liability
Legacy will not be liable for any damages arising out of the consignment or sale of the goods.
Indemnification
The Consignor agrees to indemnify and hold harmless Legacy Home & Estate Services from any and all claims, damages, liabilities, costs and expenses arising out of the consignment or sale of the goods.
Severability
If any provision of this agreement is held to be unenforceable, such provision will be struck and the remaining provisions will be enforced.
Payment of Commission
Legacy will pay the Consignor a commission on the sale of the goods, as agreed upon by both parties. The commission will be paid within 30 days of the sale of the goods.
